What does a contract with Legacy Publications entail?

By signing a contract with Legacy Publications (LP) the author wishes LP to publish the work and grants LP the nonexclusive right to print and publish, advertise, distribute, sell and ship the work in any way LP deems appropriate, and grants LP the right to distribute the work world wide, and collect all monies for books sold by LP. LP agrees to pay royalties on a quarterly basis to the author beginning with the last day of the first full month of publication if any are due.

How will Legacy Publications support me as a contracted author?

Upon receipt of a signed agreement, acceptable printed version of manuscript, and payment:

  1. Assign one of its ISBN's to the book and submit relevant information about the work to various distributors.

  2. Create a barcode for the back cover (necessary for bookstore related sales) and enter the book into their digital book printing system so that the book may be printed.

  3. Integrate the author's title and book data so it may be sold via the web.

  4. Provide information about the work to third-party sellers to enable them to sell the work, but will not be responsible for the turnaround times, submission policies, listing policies, errors, or sales policies of any third party.

  5. Not be held responsible for errors in the book including, but not limited to spelling errors, grammar, punctuation, style of work, page numbering, corrupted files, computer formatting errors, missing fonts. We will issue a printed proof book to the author for review in order to correct any problems that the author wishes LP to fix.

  6. Reserve the right to reject all work for any reason, at any time.

  7. Reserves the right to market the work, using methods it deems appropriate and to have the right to market and distribute the book world-wide.

  8. Mail statements to the author in addition to any monies due.

  9. LP is not responsible for, but will endeavor to care for and return submitted photos and artwork; and submitted disks.

  10. Issue a Form-1099 as required by the Internal Revenue Service for any earnings exceeding $600.00 in any one year.

What are my responsibilities as an author contracted with Legacy Publications?

The author will:

  1. Will pay LP a one-time setup fee of $1,400.00 and will also provide payment for any optional additional service chosen by the Author.  SUCH AS EDITING, ANY EXTRA TECHNICAL SERVICES NECESSARY FOR PUBLICATION i.e. COLOR OR COMPUTER GENERATED FIGURES OR PHOTO SCANS OR EXTRA ARTWORK (i.e. COVER DESIGN) WILL BE BILLED SEPARATELY. Any extra billing will be discussed with the author prior to publications and with author's permission. 

  2. Maintains that he/she is the legal author of the work and owner of the copyright rights of the contents of the work and has full power to enter into this Agreement; he/she is not engaged in plagiarism with respect to the work; and that the Author, if submitting work that is to include any content that does not originate from the Author or to which the Author does not own the copyright to, has obtained the copyright owner's written permission to use any such material and will provide LP with a copy of all written permissions for the use at the time of submission to LP, and that all such uses will be so noted in the work; and will send a copy of Copyright Form to LP after the form has been stamped and returned to the Author by the Library of Congress. 

  3. Guarantee LP that the work is accurate, is not in violation of anyone's privacy, is not injurious, obscene, libelous, slanderous, or otherwise a violation or infringement of any federal, state, or local law, statute or code, and further agrees to hold LP, its employees, directors, shareholders, representatives, heirs and assigns, harmless for any damages resulting from any litigation resulting from publication of the work.

  4. Author guarantees LP that the work, if fiction, does not include the name and/or any likeness of any actual persons, living or dead; and that all characters in the fictional work who may have been derived from actual persons have altered names, altered physical attributes, and are placed in altered locations so as to negate any similarity or likeness between the actual person, location, or event, and the fictional character, location. 

  5. Author understands that LP shall not in any way acquire ownership of the work and that the author is free to pursue any and all publishing venues that do not involve the use of LP's logo, barcode, copyright page, or ISBN

  6. Author grants LP the right to provide services including but not limited to the distribution of the book, advertising, sales and the printing of the work. 

  7. Author understands that LP will take the author's thumb drive (digital book file) and do its best to fix any obvious problems resulting from the file being transferred to LP's computers before sending the author a first proof book. A electronic proof will be given to the author for him/her to make the corrections suggested by the editor. Corrections will be made to the manuscript and a second electronic proof copy will be provided for the author to approve. Only after the approval is given will the book go to the fabricator to be published. Author will receive one more proof copy of a facsimile book for the authors' final approval. Changes after the final approval is given will be charged at $100.00 per each additional proof

  8. Author reserves the right to discontinue the selling of the work by LP by providing written notice to LP, and acknowledges that LP is not responsible for copies of the work that have already been manufactured, sold, and/or distributed to the market. 

  9. Author understands that the signature below ratifies all the terms and conditions of the Agreement.
